Nature of the Platform

Outcall Massage NL is an online intermediation platform that provides:

• →the ability for Clients and independent Therapists to get in touch
• →hosting of online profiles for Therapists
• →a payment system for profile visibility

Age requirement and account registration (18+)

On registration you agree to the following:

• →you are at least 18 years old
• →all information you provide is accurate and truthful
• →you are responsible for keeping your password confidential
• →you are responsible for all activity under your account
• →you may not transfer your account to anyone else

Terms for Therapists

Profile activation and fees

• →A profile becomes visible after it has been approved and the placement has been paid for.
• →Placement is charged as a package: one amount for a fixed period. The applicable rate and duration are always shown in your dashboard before you pay.
• →We may offer periods during which placement is free of charge. The same cycle length applies, and you are informed about renewal before it ends.
• →When the period ends, the profile automatically becomes invisible until it is paid for or renewed again.
• →All profiles require moderation before they go live.

Obligations of Therapists

• →you are an independent professional, NOT an employee of the Platform
• →all profile information must be truthful and not misleading
• →photos must be of yourself (no stock photos or photos of other people)
• →you must hold the required certificates, permits and insurance
• →you are responsible for your own tax returns and VAT, where applicable
• →you are fully liable for the quality and safety of your services

Professional qualifications

As a Therapist you declare that you:

• →are qualified to deliver the massage services you offer
• →hold professional liability insurance (recommended)
• →comply with all applicable Dutch laws and regulations

Ranking and visibility

The visitor's filters — city and massage type — first determine which profiles are shown at all. Within that selection, profiles are ranked by default on the moment they were last updated: the most recently updated profile appears first. Only approved, active profiles are shown.

Main parameters, in order of importance

• →the visitor's filters (city, massage type) — these determine which profiles appear at all
• →the status of the profile — only approved, active profiles are shown
• →the moment the profile was last updated — the more recent, the higher
• →a sorting by price chosen by the visitor (ascending or descending) — this replaces the default order entirely

Paid influence on ranking

Therapists can pay to place their profile at the top ("boost"). Technically, a boost sets the moment of last update to that instant, which puts the profile at the top of the default order.

Payment influences ranking only. It has no effect on moderation, approval, the display of reviews or the content of a profile. We receive no payment from third parties to rank profiles higher or lower.

Reviews

• →reviews are not checked before publication; the average score and the number of reviews are recalculated immediately after posting
• →Therapists can reply publicly to a review of their own profile, but cannot delete reviews themselves
• →we remove a review only where it breaches these terms or the law — for example abusive language, personal data of third parties, or demonstrably false content
• →we do not pay for reviews, do not request them in exchange for benefits, and do not edit their content

You can report a review via the contact address at the bottom of these terms.

Limitation of liability

The Platform acts as an intermediary and is NOT liable for:

• →the quality, safety or legality of services delivered by Therapists
• →disputes between Therapists and Clients
• →personal injury or damage during a massage
• →theft, loss of or damage to property
• →failure of Therapists or Clients to honour appointments
• →incorrect or incomplete information in Therapists’ profiles

Our total liability to you for all damages is limited to the amount you paid us in the past 12 months, up to a maximum of €100. We are not liable for indirect damage, consequential loss, lost profit, loss of goodwill or loss of data.

These limitations do not apply to the extent the law prohibits them, including in cases of intent or wilful recklessness on our part.

Payments and refunds

• →Therapists can top up their balance using the available payment methods (iDEAL, credit card and other methods shown in the dashboard).
• →All amounts are stated in euros. Whether and how much VAT is charged is shown next to the price and in the payment overview in your dashboard.
• →Refunds are provided only in the event of technical errors of the Platform.
• →We reserve the right to refuse payments or block accounts where fraud is suspected.

Unused balance is not refunded when an account is deleted, unless mandatory law provides otherwise.

Restriction, suspension and termination

Restriction or suspension of a profile

Where we restrict or suspend a profile, the Therapist concerned receives a statement of reasons on a durable medium no later than the moment the measure takes effect, setting out the specific facts and the provision we rely on.

Full termination

Where we terminate our services to a Therapist entirely, we observe a notice period of at least 30 days, likewise with a statement of reasons.

Immediate termination

We may terminate without notice where a legal or regulatory obligation requires us to, where these terms have been breached repeatedly, or where there are compelling grounds. These include in any event:

• →offering, requesting or facilitating sexual services
• →fraudulent activity
• →conduct that threatens the safety of users
• →providing false or misleading information

You can object to any measure via the contact address at the bottom of these terms. We respond with reasons.

Changes to these terms

• →We announce changes at least 15 days before they take effect, by email and in the dashboard. Where a change requires technical adjustments on your side, we apply a longer period.
• →You may terminate the agreement free of charge before that period expires. Continuing to use the Platform after the change takes effect counts as acceptance.
• →You may waive the notice period by expressly accepting the change.
• →Changes do not apply retroactively, unless a legal obligation requires it or the change is exclusively to your benefit.
• →Every version carries a version number and an effective date, both shown at the top of this page.

Reporting illegal content

Do you believe a profile or other content on the Platform is unlawful? Report it via the contact address at the bottom of these terms, stating:

• →the link to the content concerned
• →an explanation of why you consider it unlawful
• →your name and email address — except for reports about criminal offences of a sexual nature, where anonymous reporting is allowed

We confirm receipt, assess every report carefully, non-arbitrarily and objectively, and inform you of our decision with reasons. Where we remove content or restrict a profile, the user concerned also receives a statement of reasons and information about how to contest it.

Intellectual property

All content on the Platform, including text, graphics, logos, icons, images, software and the structure of the Platform, is owned by Outcall Massage NL or our licensors.

By uploading content to the Platform (photos, descriptions and the like) you grant us a non-exclusive, worldwide, royalty-free licence to use that content for operating the Platform.

Governing law and dispute resolution

These Terms and Conditions and any disputes arising from them are governed by Dutch law.

Disputes that cannot be resolved by mutual agreement will be submitted to the competent court in the district of Amsterdam, the Netherlands.
